1. Introduction

Welcome to BYO Tour Packages (“we”, “us”, “our”), trading under BYO Travelcations Private Limited. These Terms & Conditions govern your use of our website https://www.byotourpackages.com/ (“Website”), as well as all travel packages, services, and bookings made through us (“Services”). By accessing our Website or booking with us, you acknowledge that you have read, understood, and agreed to these Terms.

2. Contract Formation

  • A binding contract is created once we confirm your booking in writing (email/WhatsApp) and you pay the 20% advance deposit.
  • The remaining 80% balance is payable at the time of pick-up, directly to our assigned driver or representative.
  • All booking-related communication must be made via the contact details listed on our website.

3. Payment Terms

  • Deposit: 20% of the full tour cost is required to confirm your booking.
  • Balance: Payable when our driver picks you up on Day 1 of your itinerary.
  • We accept UPI, bank transfer, online payment links, or cash (where applicable).
  • You are responsible for any bank transfer charges, currency conversion fees, or payment gateway charges.

4. Price Revisions & Itinerary Modifications

  • Our package prices are based on current hotel rates, transport cost, taxes, and other components. If these change before your travel date, package pricing may be revised.
  • We reserve the right to modify the itinerary if required due to weather, safety, government restrictions, operational issues, or force majeure conditions.
  • In case of significant itinerary changes (e.g., hotel unavailability), we will offer equal or better alternatives at no additional cost wherever possible.

5. Cancellation Policy

If you need to cancel your booking, you must inform us in writing (email/WhatsApp). Our cancellation charges are:

  • More than 30 days before travel: 10% of package cost
  • 29 to 15 days before travel: 20% of package cost
  • 14 to 8 days before travel: 40% of package cost
  • 7 days or less: 100% (no refund)
  • No-show on travel day: 100% cancellation
  • Early departure after tour begins: No refund for unused services

Note: Some hotels, flights, and high-season bookings may have stricter conditions. If applicable, those will override the standard policy.

6. Refunds

  • Eligible refunds will be processed within 7–21 working days.
  • Refunds are issued only to the original payer.
  • Payment gateway fees or bank charges are non-refundable.
  • Refunds depend on the policies of our hotel, transport, and activity partners.

7. Customer Responsibilities

  • Provide accurate passenger information (full names, ID details, dates, special requests).
  • Carry valid ID proofs, travel permits, or government-mandated documents.
  • Ensure that you are medically fit to travel and participate in activities.
  • Follow instructions given by our tour guides, drivers, or local partners.
  • Respect local customs, laws, and the safety guidelines of each destination.

8. Our Liability Limitations

We act as an aggregator of hotels, transport providers, drivers, guides, and activity operators. All services are provided by independent contractors.

We are not liable for:

  • Personal injury, loss, or damage caused by third-party providers
  • Delays or cancellations due to weather, strikes, traffic, road blockage, or government orders
  • Loss of luggage, valuables, or personal items
  • Missed flights or connections due to factors beyond our control
  • Natural calamities, pandemics, political unrest, or force-majeure situations

Our liability, under any circumstances, will not exceed the amount you paid us for the booking.

9. Force-Majeure

We are not responsible for service disruption caused by events beyond our reasonable control, such as:

  • Natural disasters
  • Floods, landslides, heavy rains, storms
  • Bandh, strikes, protests
  • Epidemics or travel bans
  • Government actions
  • Transport breakdowns
  • Any unpredictable event creating safety risk

In such cases, refunds depend entirely on partner hotel/transport policies.

10. Special Requests

Any special request (dietary preferences, room type, honeymoon decor, accessibility needs) must be provided at booking time.
We will pass these to suppliers but cannot guarantee fulfilment unless confirmed in writing.

11. Health & Fitness

  • You must disclose any medical conditions that may affect your travel.
  • We may refuse bookings or participation if your condition poses a risk to yourself or others.
  • We strongly recommend comprehensive travel insurance.

12. Behaviour Policy

We reserve the right to cancel or terminate your participation without refund if you:

  • Misbehave with staff/drivers
  • Disturb other customers
  • Indulge in unlawful activities
  • Damage property
  • Travel while intoxicated or endanger safety

You will be required to bear the cost of any damage you cause.

13. Intellectual Property

All content on byotourpackages.com—text, images, graphics, branding—is owned by BYO Travelcations Pvt Ltd.
You may not copy, reproduce, or distribute our content without written permission.

14. Privacy & Data Protection

  • We do not store any credit/debit card information at any stage.
  • We collect customer information (name, phone number, email, travel dates) only to provide service and support.
  • We use your data for:
    • Booking confirmations
    • WhatsApp updates & travel communication
    • WhatsApp marketing (offers, new packages, reminders)
  • We do NOT sell, rent, or share your data with any third parties.
  • Your data is stored securely and only used by our internal team for service communication.

15. Website Usage

You must use our website only for lawful purposes.
You must not:

  • Try to hack, modify, or reverse-engineer the site

16. Governing Law & Jurisdiction

These Terms are governed by the laws of India.
All disputes shall be subject to the exclusive jurisdiction of the courts of Amritsar, Punjab, unless otherwise required by Indian law.

18. Severabilit

If any clause in these Terms becomes invalid or unenforceable, the remaining clauses will continue in effect.

19. Entire Agreement

Your booking confirmation, invoice, communication messages, and these Terms & Conditions together form the entire binding agreement between you and BYO Travelcations Pvt Ltd.
